Terms of Service

These terms govern your use of RotatorTOTS ("the Service", "we", "us"), a product of solvely. By using the Service you agree to them. If you're agreeing on behalf of a company, you represent that you have authority to bind that company.

1. Account

You must be at least 16 and provide accurate account information. You're responsible for keeping your credentials secure and for all activity under your account.

2. Acceptable use

You agree not to:

  • Use the Service to send spam, unsolicited outreach, or harass contacts.
  • Reverse engineer, resell, or sublicense the Service without written permission.
  • Disrupt the Service (DoS, excessive automation, probing for vulnerabilities outside a responsible disclosure program).
  • Upload malware or violate any applicable law.

3. Your data

You retain all ownership of data you bring into the Service (CRM records, rules, buckets, team info). You grant us a limited license to store, process, and transmit that data solely to deliver the Service. We don't sell it, don't train ML models on it, and don't share it with third parties except the sub-processors listed in our Privacy Policy.

4. Availability

We aim for high availability and continuously deploy updates. We do not guarantee uninterrupted service. Enterprise customers may receive a separate written SLA in their order form.

5. Payment

  • Pricing is per active seat (one license per HubSpot owner placed in a rotation). Admin, viewer, and reporting users are free. Minimum 3 seats per workspace.
  • New customers start with a 14-day trial that includes full Scale features regardless of selected plan. A payment method is required at signup; we will not charge until trial ends. Cancel any time during the trial to avoid charges.
  • Subscriptions renew monthly or annually depending on the interval you select. Annual subscriptions are billed once per year at a 20% discount versus the monthly rate. All fees are in USD and processed by Stripe.
  • Increases (adding seats, upgrading plan, switching to annual) take effect immediately and are charged on a prorated basis to your card on file.
  • Decreases (removing seats, downgrading plan, switching from annual to monthly) take effect at the end of the current billing period. We do not issue automatic refunds or credits for decreases. If you have an exceptional circumstance (e.g. a significant seat reduction mid-annual-term), email help@solvely.net and we will consider a manual prorated credit at our discretion.
  • Cancel any time from the Billing page. Cancellation takes effect at the end of the current period. Already-paid amounts are non-refundable.
  • Routing is unlimited on every plan, subject to fair-use review for sustained abnormal volumes. Payment failures may result in service suspension after standard retry attempts.

6. Third-party services

Connecting HubSpot (or future integrations) requires you to accept that provider's terms. We're not responsible for those providers' actions, outages, or billing.

7. Termination

You can delete your workspace any time from Settings. We may suspend or terminate accounts that violate these terms or that have been inactive for 12+ months. On termination we purge OAuth tokens immediately and workspace data within 30 days.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE MAXIMUM EXTENT PERMITTED BY LAW.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOLVELY'S AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED THE FEES YOU PAID US IN THE 12 MONTHS PRIOR TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST DATA.

10. Indemnity

You agree to indemnify and hold solvely harmless from claims arising from your use of the Service in violation of these terms or applicable law.

11. Governing law

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws rules. Disputes shall be resolved in the state or federal courts located in San Francisco County, California.

12. Changes to these terms

We may update these terms. Material changes will be notified by email to workspace admins at least 30 days before they take effect. Continued use after the effective date means you accept the updated terms.
